
The telecom ministry has clarified that an earlier audit observation suggesting revenue loss to Bharat Sanchar Nigam Limited (BSNL) in its agreement with Reliance Jio Infocomm was based on a misinterpretation of a contractual clause.
The ministry stated that the issue has since been reviewed and corrected. Revised invoices have now been issued to address the matter and ensure clarity in the agreement’s implementation, as per The Economic Times report.
In a report released last year, the Comptroller and Auditor General (CAG) stated that BSNL had not enforced certain provisions of its Master Service Agreement (MSA) with Reliance Jio Infocomm Ltd.
According to the audit body, BSNL did not bill the telecom operator for additional technology used on the company’s shared passive infrastructure. The CAG estimated that this resulted in a potential revenue loss of ₹1,757.76 crore, including penal interest, for the period between May 2014 and March 2024.
Minister of State for Telecom Pemmasani Chandra Sekhar, in a written reply to the Rajya Sabha, said the estimate was based on an incorrect interpretation of a clause related to add-on technology in the agreement.
He noted that the ambiguity in the clause has now been rectified and clarified. According to the ministry, the issue did not lead to an actual revenue loss for BSNL or the government.
BSNL has a Master Service Agreement with Reliance Jio that allows the telecom operator to lease space on BSNL’s tower infrastructure to install its equipment.
Following the clarification, BSNL has issued revised invoices to Reliance Jio in line with the corrected interpretation of the contractual clause.
