
The Bombay High Court has provided significant relief to telecom giants Bharti Airtel and Vodafone Idea by quashing the Department of Telecom's (DoT) decision to impose a one-time spectrum charge (OTSC), as per news reports.
This decision addresses a long-standing ₹20,000 crore dispute dating back to 2012.
On June 8, 2026, the Bombay High Court ruled against the DoT's 2012 decision to levy a retrospective OTSC.
The Division Bench, comprising Justices Manish Pitale and Shreeram V. Shirsat, found that the government failed to justify the retrospective imposition of the charge.
Consequently, the court directed the Centre to return the bank guarantees deposited by Airtel and Vodafone Idea.
The court's decision came after writ petitions were filed by the telecom companies challenging the levy. The court highlighted that the government's attempt to equate revenue maximisation with public interest was unjustified.
The OTSC levy originated in January 2012 when the Supreme Court cancelled 122 telecom licences.
In December 2012, the DoT issued demand notices for a one-time charge on spectrum beyond 6.2 MHz, retrospectively from July 2008.
Airtel and Vodafone idea contested the levy, arguing it was not permitted under the Indian Telegraph Act, 1885, or the licence agreements.

In 2023, Airtel reported OTSC dues of ₹15,178 crore, with ₹8,500 crore provided for and ₹6,600 crore as contingent liability.
Vodafone Idea declared OTSC dues of approximately ₹7,000 crore. The relief from the court could amount to over ₹20,000 crore for both companies.
The court's decision also disagreed with a 2016 Madras High Court judgment in the Aircel case, which upheld a similar levy.
The matter is currently pending in the Supreme Court, where the DoT has appealed against a 2019 Telecom Disputes Settlement and Appellate Tribunal (TDSAT) ruling that turned down the OTSC demand.
