Why an Indian Passport Alone Doesn't Prove Citizenship, Centre Explains

The Union government has clarified that an Indian passport is not considered conclusive proof of citizenship under the law. The Centre stressed that this is not a new policy or a recent change but a long-standing legal position. 

Government Responds to Citizenship Debate 

The clarification came after comments from a Ministry of External Affairs (MEA) official, who stated that a passport is mainly a travel document and should not be treated as final proof of citizenship. 

The remarks sparked public debate and criticism from opposition leaders, with some questioning whether the government was reducing the legal value of passports. 

No Change in Government Policy 

Government sources said there has been no change in the official position regarding passports and citizenship. 

According to officials, a passport has never been considered definitive proof of citizenship under Indian law. They emphasised that this interpretation has existed for decades and is not a recent development. 

What Does the Law Say? 

The Centre pointed to the Passports Act, 1967, which allows passports to be issued to certain non-citizens under specific circumstances. 

Officials said that while passports are issued after verification, possessing a passport alone does not legally establish citizenship beyond doubt. 

Judicial Precedents Support the View 

Government sources also referred to court rulings, including judgments from the Bombay High Court, which have stated that a passport by itself cannot be treated as conclusive evidence of citizenship. 

The Centre said these legal interpretations have been in place for years. 

How Is Citizenship Determined? 

Under the Citizenship Act, 1955, and related rules, Indian citizenship can be acquired through 5 methods: 

  • Birth
  • Descent
  • Registration
  • Naturalisation
  • Incorporation of territory 

The government noted that citizenship is determined under these legal provisions and not solely through possession of a passport.

Aadhaar and Citizenship 

The debate has also revived discussions around identity documents. Courts have previously observed that Aadhaar serves as an identity document but is not conclusive proof of citizenship. 

Similarly, the government maintains that a passport confirms identity and enables international travel but is not, by itself, final proof of citizenship.

The Centre has reiterated that an Indian passport is primarily a travel document and not conclusive proof of citizenship under existing laws. According to the government, this legal position has remained unchanged for many years and is supported by statutory provisions as well as court rulings.
