The Department of Telecommunications (DoT) has notified rules to operationalise the Telecom Act, 2023, replacing the existing licence regime with an authorisation-based framework, as per news reports. 

The new rules provide a transition mechanism for existing telecom operators and introduce fresh compliance requirements covering data protection, fraud prevention, and digital connectivity services. 

Licence Regime Replaced with Authorisation Framework 

The notified rules replace the existing telecom licensing regime with an authorisation-based system. Existing licence holders will be allowed to migrate to the new framework, providing a roadmap for telecom service providers to transition to the updated regulatory structure. 

Single-Window Clearance Through Telecom eServices Portal 

The framework introduces a single-window clearance mechanism through the Telecom eServices Portal. The portal will facilitate applications for telecom authorisations and support migration from existing licences.  

The rules create a separate authorisation category for in-flight connectivity services. This provision enables such services to be offered under the new authorisation framework. 

AI and Big Data to Be Used for Fraud Prevention 

Telecom operators will be required to deploy artificial intelligence and big data analytics tools for fraud detection and prevention. The rules also mandate anti-spoofing and anti-fraud measures to strengthen user protection and telecom security. 

Data Localisation Requirements Introduced 

Under the framework, newly authorised entities will not be permitted to transfer user data outside India. The provision establishes a formal data localisation requirement under the Telecom Act, 2023. 

Framework for M2M and Enterprise Networks 

The rules provide a statutory basis for captive non-public networks, enterprise communication systems, and machine-to-machine (M2M) services. 

Companies, societies, courts, and government bodies can obtain M2M authorisation for applications such as Internet of Things (IoT) deployments, smart meters, and connected vehicles.
