Dabur Share Price in Focus After Court Blocks Use of Wellford Pudin Hara Name

Dabur Indiashare price has come into focus after the Delhi High Court restrained the use and registration of the trademark ‘Wellford Pudin Hara’. The court order will remain in force until March 17, the next date of hearing. The decision supports Dabur’s claim that the disputed name closely imitates its well-known ‘Pudin Hara’ brand.

Why Did Delhi HC Restrict Wellford Pudin Hara? 

The court noted that the contested trademark fully contains Dabur’s registered mark and could easily mislead consumers. Since both products are used for similar purposes and are sold to the same group of buyers, the likelihood of confusion was considered strong. The court also observed that consumers may wrongly assume a connection or association between the two products.

Allowing the disputed trademark to continue during the case was seen as potentially harmful to Dabur, leading the court to pause its use and registration.

Dabur’s Longstanding Brand History Considered

Dabur highlighted that it has been using the ‘Pudin Hara’ name continuously since 1930. Over the years, the product has built strong recognition and trust among consumers. The company also pointed out that it applied for trademark registration in 1979.

In comparison, Wellford Pharmaceuticals applied for trademark registration in 2022 on a proposed-to-be-used basis. The registration was granted in 2023. The court considered this difference in timelines while examining the dispute.

Products Serve the Same Consumer Market

Both Dabur’s product and the disputed one are mint-based, over-the-counter remedies used for indigestion and stomach discomfort. Given their similar nature and shared consumer base, the court agreed that buyers familiar with Dabur’s product could be misled by the similar naming.
