A fresh legal challenge has emerged for SpiceJet Limited after the Delhi High Court directed the airline to disclose its assets in a sealed cover during proceedings linked to an overseas commercial court decree involving unpaid aircraft engine lease dues, as per news reports.

Court Seeks Asset Disclosure from SpiceJet

Justice Vikas Mahajan instructed SpiceJet to submit details of its assets within three weeks while hearing a petition filed by Sunbird France 02 SAS.

The matter relates to enforcement of a foreign decree issued by the England & Wales Commercial Court in favour of the France-based engine lessor.

Sunbird has sought recovery of more than ₹70 crore connected to aircraft engine leasing arrangements signed with the airline.

The court also granted interim relief to the lessor and allowed the company to approach the Vacation Bench if any urgent developments arise before the next hearing.

Lessor Raised Concerns Over Financial Stability

During the proceedings, counsel representing Sunbird argued that pending insolvency petitions involving SpiceJet created concerns regarding the airline’s financial position and justified immediate interim protection.

The lessor’s legal team also referred to reports regarding advance salary payments made to SpiceJet promoter Ajay Singh while lease-related dues allegedly remained unsettled.

Representing Sunbird, Anandh Venkataramani, instructed by Saket Satapathy, argued that the overseas decree satisfied enforceability requirements under Indian civil law provisions.

Sunbird additionally submitted before the court that SpiceJet did not contest proceedings before the UK court despite receiving proper notice.

SpiceJet Opposes Interim Relief

Senior Advocate Amit Sibal, appearing for SpiceJet, opposed the interim directions by questioning both maintainability and enforceability aspects of the proceedings.

The airline also told the court that it remains a listed company and is currently working on raising funds through a government-backed package.

The matter has now been scheduled for further hearing on July 29.

Lease Dispute Dates Back To 2019 Agreements

The dispute originates from three aircraft engine lease agreements executed in 2019.

According to Sunbird, SpiceJet allegedly defaulted on lease rentals and maintenance obligations beginning in 2020. Following the defaults, the lessor repossessed the engines between 2022 and 2023.

Conclusion

The ongoing dispute adds to the legal and financial challenges facing SpiceJet as the airline continues dealing with multiple claims linked to aircraft leasing and payment obligations.
