Non-Resident Indians (NRIs) may find their PAN showing as inoperative due to their Aadhaar not linked.  

However, under Indian income-tax law, certain NRIs are exempted from this requirement. Before paying the ₹1,000 delayed fee, it is crucial to confirm non-resident status. 

Exemption Criteria for NRIs 

In general, The Income Tax Department's FAQ states that NRIs are exempt from mandatory Aadhaar-PAN linking.  

Also, Others exempt include individuals aged 80 years or more, people in Assam, Jammu and Kashmir, or Meghalaya, and non-Indian citizens. NRIs should not hastily pay the fee without verifying their exemption eligibility. 

Steps for NRIs with Inoperative PAN 

In July 2023, the Income Tax Department clarified that NRIs with inoperative PANs should inform their jurisdictional Assessing Officer (JAO) of their NRI status.  

Required documents include a PAN card, proof of non-residency like a passport showing travel history, a PIO card, OCI card, and if applicable, a national ID or Taxpayer Identification Number.

Finding Your Assessing Officer 

NRIs can use the "Know Your AO" facility on the Income Tax Department’s e-filing portal to locate their JAO without needing to log in.  

It’s important to note that living abroad is not enough for exemption; the individual must meet the non-resident criteria under the income-tax provisions. 

Impact of Inoperative PAN on Tax Refunds 

An inoperative PAN can delay tax refunds for those required to link Aadhaar. However, communications from the department in 2026 indicate that this does not affect individuals exempt from Aadhaar-PAN linking. NRIs should ensure correct exemption status to avoid issues. 

Document Submission Process 

NRIs can submit necessary documents like the PAN card, passport, PIO or OCI card, and Taxpayer Identification Number if applicable. These must be presented to prove NRI status and correct the PAN’s status through the designated process.
