ESIC Extends New Amnesty Scheme 2025 till December 31, 2026

The Employees’ State Insurance Corporation (ESIC) has extended its New Amnesty Scheme, 2025, until December 31, 2026. The scheme was due to end on September 30, 2026, but will now continue for another three months under the same terms and conditions.
The extension follows representations from various stakeholders, ESIC said in a press release issued through the Press Information Bureau on October 29, 2026.
The scheme covers eligible employers and insured persons involved in legal disputes under the erstwhile Employees’ State Insurance (ESI) Act.
Payments Required for Settlement
Under the scheme, employers facing ad-hoc assessments can settle their cases by paying the actual contributions due along with interest. No damages will be levied in these cases.
Employers who have already paid their dues can seek withdrawal of pending cases by paying 10% of the disputed damages. The scheme also covers cases filed by ESIC over the non-submission of records or delayed payments, provided the employer has since met the requirements.
Withdrawal of these cases is subject to court permission.
Which Cases Are Eligible?
The scheme applies to court cases filed on or before March 31, 2025. Employers must meet the scheme’s conditions to qualify for settlement.
The initiative was introduced as a one-time measure to resolve disputes between employers and ESIC outside court. It covers cases involving contribution payments, damages and compliance with requirements under the erstwhile ESI Act.
Revised Deadline
With the extension, eligible employers have until December 31, 2026, to settle their cases under the scheme. The existing payment conditions and eligibility rules remain unchanged.

Conclusion
The extension gives employers additional time to complete settlements before the scheme closes. Cases that do not meet the prescribed conditions will not qualify under its provisions.
