India-Israel Bilateral Investment Agreement Comes into Force on July 4, 2026, Nearly 10 Months After Signing

The Bilateral Investment Agreement (BIA) between India and Israel came into force on 4 July 2026, the Ministry of Finance said, as per a PIB report. The agreement was signed in New Delhi on 8 September 2025 after negotiations between the two countries.  

With the treaty now operational, investments covered under the agreement will be governed by a common set of rules agreed upon by both governments. 

Legal Framework for Investments 

The agreement sets out the conditions under which investments made by Indian and Israeli investors will be treated in the host country.  

It covers issues related to investment protection, dispute provisions and the obligations of both governments. The treaty also specifies the scope of investments and investors that qualify for protection under its provisions. 

The Department of Economic Affairs said the agreement has been framed to provide legal certainty for investment activity while clearly defining the rights and responsibilities of the parties involved. 

Balance Between Investor Protection and Regulation 

According to the government, the treaty seeks to protect investments without restricting the ability of either country to introduce laws in the public interest.  

It preserves the policy space available to governments to deal with matters such as public health, environmental protection, national security and other domestic priorities. 

The agreement follows India's revised Bilateral Investment Treaty model, which differs from several older treaties by placing greater emphasis on the regulatory powers of the host government alongside investment protection.  

Part of Wider Economic Relations 

India and Israel maintain cooperation across sectors including agriculture, technology, defence, water management and healthcare.  

The investment agreement adds a dedicated legal framework covering bilateral investments and forms part of the economic relationship between the two countries.
