Government Proposes Immediate Manufacturing Licence Suspension for Drugs Failing Key Quality Tests

The government has proposed a stricter approach towards medicines that fail key quality tests. Under the draft rules, regulators could immediately suspend a manufacturer's licence in specified cases.
The proposed change is aimed at reducing the gap between a drug being declared not of standard quality and regulatory action being taken.
Four Types of Quality Failures Covered
The proposal applies when government testing finds failures related to impurities, sterility, assay or dissolution.
These tests cover important aspects of a medicine's quality, including the amount of active ingredient and how the drug releases it.
Faster Action Against Failed Drug Batches
Under the current system, regulators generally issue a show-cause notice before suspending or cancelling a manufacturing licence.
The Health Ministry has said this process can create a delay, during which a drug declared not of standard quality may continue to remain in circulation.
Conditions for Restoring the Manufacturing Licence
A suspended licence would remain so until the manufacturer identifies the cause of the quality failure and takes corrective and preventive action.
The regulator would need to verify these measures before the manufacturing licence could be restored.
Stronger Oversight of Quality Investigations
The draft would also allow the central licensing authority to seek investigation reports, root-cause analyses and details of corrective measures from manufacturers.
Government laboratory reports would be shared with the Drugs Controller General of India, the relevant state or Union Territory regulator, and the manufacturer and marketer named on the product.
Public Consultation and Implementation
The government has invited comments on the draft within 30 days. The proposed rules would come into effect after their final publication in the Official Gazette.

Conclusion
The proposal would make regulatory action faster in specified cases of serious quality failures. If finalised in its current form, certain failed test results could lead to an immediate suspension instead of action beginning with the existing notice process.
