
The Delhi High Court has granted temporary relief to Britannia Industries by issuing an ad-interim injunction against Shri Swastik Organics and its associates for infringing its “Little Hearts” biscuit brand and design, as per The Live Law report.
The rival had used identical product elements including the name, shape and packaging, prompting allegations of deliberate dishonesty.
On December 23, 2025, Justice Manmeet Pritam Singh Arora ruled that Britannia had established a strong prima facie case of infringement. The Delhi High Court found that the biscuits sold by Shri Swastik Organics matched Britannia’s “Little Hearts” in mark, heart shape and sale channels, thus causing consumer confusion. The Court applied the “triple identity” test — identical product, identical mark, and identical trade channel.
Britannia informed the Court that it has used the “Little Hearts” mark since 1988 and its heart-shaped, sugar-coated biscuits were first launched in 1993. The brand holds registered trademarks for both the wordmark and the biscuit's 3D shape. Supporting its case, Britannia shared sales data reflecting significant market presence and goodwill attached to the product.

The infringement came to Britannia’s notice in December 2025 through listings on Amazon, where biscuits with the same name and shape were sold. The product descriptions even made reference to “Britannia Little Hearts” and used images replicating the original packaging. After buying the product, Britannia traced the sellers to Shri Swastik Organics and its affiliates.
The Court highlighted the dishonest intent of the defendants, noting use of copyrighted images and packaging likely to mislead the average consumer. It granted an interim injunction and directed Amazon to remove all infringing listings. The order remains in effect until further directions. The case is next scheduled for hearing on May 21, 2026.
The Delhi High Court’s ruling offers Britannia temporary protection against misuse of its “Little Hearts” branding and design. The injunction aims to prevent customer deception and uphold intellectual property rights until the matter is finally adjudicated.
