As per the Live Law reports, the Delhi High Court has closed a trademark infringement case filed by Nestlé S.A., owner of the Maggi brand, against Shankeshwar Utensils & Appliances Pvt. Ltd. 

The order was passed after the two parties reached a settlement. Justice Tejas Karia recorded that the defendant will no longer use the mark “Maggisun” or any other name resembling “Maggi.”

Origin of the Dispute

Nestlé, under its corporate name Societe Des Produits Nestlé SA, filed the suit in 2018. The company stated that Shankeshwar Utensils was selling pressure cookers under the brand “Maggisun,” which it argued was an infringement of its well-known Maggi trademark.

Settlement Terms

As part of the settlement, Shankeshwar Utensils acknowledged Nestlé as the proprietor of the Maggi trademark. It agreed not to manufacture, sell, or advertise any products using “Maggisun” or similar names. The company also undertook to cancel its trademark registration for “Maggisun” and to destroy all goods, labels, and packaging carrying the disputed mark.

Court Order

The court decreed the suit in line with the terms agreed between the parties. Nestlé’s counsel confirmed that no further claims would be pursued. The order directed both parties to remain bound by the settlement.

Maggi’s Market in India

Maggi is a leading product for Nestlé India, with six billion servings sold in FY24. India is currently the largest market for Maggi worldwide. The company has reported growth in its prepared dishes and cooking aids segment, supported by demand for Maggi noodles and related products.

Past Regulatory Issues

In June 2015, Maggi was banned for five months after the Food Safety and Standards Authority of India reported lead levels above the permissible limit of 2.5 ppm. The brand, which then held 80% of the noodles market, lost most of its share. Nestlé India has since launched more than 140 products and is investing ₹7,500 crore between 2020 and 2025 to strengthen operations.

Conclusion

The closure of the case brings an end to the trademark dispute. The settlement confirms Nestlé’s rights over the Maggi brand and prevents further use of similar marks.
