Dabur India has initiated legal action against Patanjali Ayurved in the Delhi High Court, accusing it of trademark infringement regarding the packaging of 'Dant Kanti Red' toothpaste. The court has allowed the suit to proceed following unsuccessful mediation efforts.

Trademark Dispute Over Toothpaste Packaging Design

The lawsuit revolves around Patanjali's redesigned packaging for 'Dant Kanti Red', launched in December 2024. Dabur alleges that the new packaging closely resembles its own product, creating consumer confusion. The concern is not over the use of the word 'Red' or the symbolic pan leaf, but the overall package appearance, which it claims mirrors Dabur’s trade dress.

Mediation Fails, Legal Process Initiated

Justice Manmeet Pritam Singh Arora of the Delhi High Court confirmed that mediation between the two companies failed. As per Section 12A of the Commercial Courts Act, Dabur had fulfilled its pre-institution mediation obligations. The court proceeded with formal case registration, setting procedural timelines for further hearings.

Timelines Set for Legal Proceedings

The court granted Patanjali 30 days to submit its written statement supported by affidavit documents. Dabur would then have another 30 days to file a replication. The court warned that unsupported denials could attract cost implications. Document inspections will follow the Delhi High Court (Original Side) Rules, 2018.
