
Akasa Air has been ordered by a Delhi court to compensate a travel agency ₹1.08 crore after the airline abruptly cancelled 640 holiday seats to Goa during the bustling Christmas-New Year period. The decision highlights the importance of contractual obligations in the travel industry.
The Saket Commercial Court heard the case put forth by ABS Tour & Travels, a Delhi-based travel agency that accused Akasa Air of specific breaches.
The travel agency had booked 8 Passenger Name Records (PNRs), each comprising 80 seats, for trips from Delhi to Goa and back. Akasa Air's sudden cancellation after accepting partial payment was deemed a breach of contract.
ABS Tour & Travels alleged that it had faced a significant loss due to the abrupt cancellation, which involved already confirmed PNRs during the high-demand festive season.
The court ruled that a contract was formed under the Indian Contract Act, 1872, as PNRs had been generated and a deposit received.
The court decided in favour of ABS Tour & Travels, awarding them ₹1.08 crore in compensation.
Despite Akasa Air's claim that they refunded the advance payment, the court stated this didn't nullify the potential damages from the breach of contract. Akasa Air maintained that the agency had not sold any of the tickets, but this argument was not upheld.
Arguing dynamic pricing, Akasa Air contended their actions were reasonable. However, the ruling emphasised the necessity for airlines to honour confirmed bookings, especially during peak seasons when travel agencies rely heavily on such contracts.
