IndiGo Sues Mahindra Electric Over Trademark Dispute on ‘6E’

IndiGo has initiated legal action against Mahindra Electric Automobile Limited (MEAL) over the use of “6E” in the latter’s newly unveiled electric vehicle, the BE 6E. The lawsuit was filed in the Delhi High Court on Tuesday, with IndiGo alleging trademark infringement.

The term “6E” is synonymous with IndiGo’s branding and represents its airline operations. In its filing, IndiGo argued that the use of “6E” in the BE 6E model could lead to confusion and infringe upon its well-established trademark. The case was presented before Justice Amit Bansal but was deferred after the judge recused himself. The next hearing is scheduled for December 9, 2024.

Mahindra’s Response

Mahindra, in its response, clarified that the BE 6E is part of its electric SUV portfolio and that it had applied for trademark registration under Class 12 (vehicles). The company emphasised that its mark, “BE 6e,” is distinct from IndiGo’s “6E” in both application and style. Mahindra further stated that its trademark is specific to vehicles, fundamentally differing from IndiGo’s use in the aviation sector.

Acknowledging IndiGo’s concerns, Mahindra affirmed that it had no intention of infringing on the airline’s goodwill and is engaged in discussions to reach an amicable resolution.

The dispute highlights the complexities of trademark law, especially when trademarks are shared across industries. Mahindra assured investors that it remains compliant with all disclosure obligations under listing regulations and will continue to keep stakeholders informed about material developments.

On December 4, 2024, IndiGo share price opened at ₹4,424.00, up from its previous close of ₹4,405.50. At 9:41 AM, the share price of IndiGo was trading at ₹4,429.70, up by 0.55% on the NSE.

On the other hand, M&M share price opened at ₹3,003.00, down from its previous close of ₹3,027.30. However, at 9:43 AM, the share price of M&M was trading at ₹3,030.00, up by 0.09% on the NSE.
