
As H-1B visa fees have risen, many Indian professionals aiming to work in the United States are increasingly opting for the EB-1A and EB2-NIW route. These pathways allow more stability, long-term planning, and independence from employer sponsorship.
In the Q1FY25, the United States Citizenship and Immigration Services (USCIS) received more than 7,300 EB-1A petitions from global applicants. As per news reports, a large share of these applications were Indians.
The EB-1A visa is meant for individuals with extraordinary ability in various fields. This includes science, arts, business, and education. Applicants need to demonstrate exceptional achievements and meet 3 out of 10 specified criteria. This visa is does not require employer sponsorship, which makes it a popular choice among applicants.
The EB2-NIW (National Interest Waiver) category is gaining traction among qualified professionals who want to work for the USA. They can belong to fields like research, technology, public policy, and healthcare, among others.
The EB2-NIW route allows applicants to seek a green card without the need for employer backing, provided they can show that their work benefits the country.
The H-1B programme has long been one of the most common ways for skilled Indian workers to enter the US. However, recent changes have made it far more challenging. The introduction of a US$100,000 fee for new H-1B applications from September 2025 and heightened scrutiny of petitions have added to the uncertainty.
Many professionals now prefer visa routes that do not depend on a lottery system and are less affected by political or policy shifts. The recent wave of layoffs in the global tech sector has also encouraged workers to opt for visas that offer more security and flexibility.

As the H-1B visa becomes tougher and more expensive, Indian professionals are increasingly exploring alternatives like EB-1A and EB2-NIW.
