
The Government has asked social media and digital platforms to introduce systems to identify and manage artificial intelligence-generated material. The changes fall under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2026.
As per news reports, the revised rules are scheduled to take effect from February 20, 2026, and apply to platforms that host or distribute user content.
Platforms must ensure that AI-generated material is clearly marked. The notification requires such content to carry visible labels stating that it has been created using computer tools.
In addition, the material must include embedded identifiers or permanent metadata, such as a unique code, indicating it is synthetic. Once applied, these labels or identifiers cannot be removed, altered, or hidden.
The amendments introduce a formal definition of “synthetically generated information”. This covers audio, visual, or audio-visual content created or modified using computer tools in a way that may appear real or authentic.
Routine edits such as formatting, translation, basic enhancement or accessibility changes will not be treated as synthetic if they do not change the meaning or context of the original material.
Intermediaries that allow such material to be created or shared must use technical measures, including automated tools, to prevent unlawful content. The notification lists categories such as child sexual abuse material, non-consensual imagery, false documents, and content that misrepresents a person or event.
Platforms are required to act quickly after becoming aware of such violations.
Significant social media intermediaries must obtain a declaration from users stating whether the uploaded material is synthetic. They must also verify these declarations using technical checks before publication.
Platforms are required to inform users at least once every three months about rules, penalties, and consequences for violations.
The notification states that references to unlawful “information” also include synthetically generated material. Users who create or share illegal synthetic content may face action under the Information Technology Act and other applicable laws.
