Reasons for Demand Notice

The GST authorities have identified discrepancies in the company’s GST filings for FY 2018-19:

  • Turnover Mismatch: A discrepancy exists between the turnover declared in GSTR-1 (sales return) and GSTR-9 (annual return). This mismatch could indicate unreported sales, potentially leading to tax underpayment.
  • Input Tax Credit (ITC) Discrepancies: The demand notice also highlights a difference between the ITC claimed in the company’s returns and the ITC automatically populated on the GST portal. This might suggest the company availed of ineligible tax credits.

Despite the demand order, HCL Infosystems is exploring its legal options. The company intends to file an appeal against the demand order before July 26, 2024. To contest the notice, they may need to deposit a pre-deposit of 10% of the tax demand, which translates to approximately ₹0.09 crore.
